Child Support in Illinois

Published

If divorce is something you’re facing, we urge you to contact the Crosby Law Firm. As family practice and child support lawyers in Rockford, IL, we know the question of child support is often an integral part of these proceedings, and here are some of the basic facts you should know.

Calculating child support

The state of Illinois has child support guidelines the courts must follow to determine the support one parent must pay another. Basic support is based on the non-custodial parent’s net income, from 20% for one child up to 50% for six or more children.

Formula adjustments

Illinois judges can make adjustments if the guideline amount does not address the child’s best interests. Relevant factors include the child’s probable standard of living had divorce not occurred, their physical and emotional condition, their educational needs, and the financial resources and needs of the child and both parents.

The court may also add expenses to the guideline amount for things like daycare, health care, extracurricular activities and private school tuition.

Termination or modification of child support

In Illinois, child support normally ends when they reach age 18 unless they’re attending high school full time. Then, support ends at 19 or upon graduation, whichever comes first.

These are just some of the very basic facts regarding child support, and if you need the assistance of a child support lawyer in Rockford, IL, contact Crosby Law Firm today for your initial free consultation.
